By accessing or using Moto Mass ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Platform.

2. Description of Service

Moto Mass is an online marketplace that connects motorcycle riders ("Riders") with tour operators ("Operators") offering motorcycle tours and experiences. We facilitate the discovery, booking, and payment process but are not the provider of the tours themselves.

3. User Accounts

Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be responsible for all activities under your account

Account Termination

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent, abusive, or illegal activities.

4. Bookings and Payments

Booking Process

When you book a tour through Moto Mass, you enter into a direct agreement with the Operator. We facilitate this transaction but are not a party to the contract between you and the Operator.

Payments

All payments are processed securely through our payment providers. Prices are displayed in the currency specified and may be subject to additional fees or taxes as indicated at checkout.

Cancellations and Refunds

Cancellation policies are set by individual Operators and displayed on each tour listing. Please review the cancellation policy before booking. Refund processing times may vary.

5. User Responsibilities

For Riders

  • Ensure you meet all requirements specified by the Operator (license, experience level, etc.)
  • Provide accurate information when booking
  • Arrive on time and follow Operator instructions
  • Maintain appropriate insurance coverage
  • Ride responsibly and within your skill level

For Operators

  • Provide accurate tour descriptions and pricing
  • Maintain all necessary licenses and insurance
  • Ensure equipment is safe and well-maintained
  • Honor confirmed bookings
  • Respond promptly to rider inquiries

6. Prohibited Activities

You agree not to:

  • Violate any applicable laws or regulations
  • Post false, misleading, or fraudulent content
  • Harass, abuse, or harm other users
  • Circumvent our booking or payment systems
  • Use the Platform for unauthorized commercial purposes
  • Attempt to gain unauthorized access to our systems
  • Post content that infringes intellectual property rights

7. Reviews and Content

Users may post reviews and other content. You retain ownership of your content but grant us a non-exclusive license to use, display, and distribute it on our Platform. Reviews must be honest, based on genuine experiences, and comply with our content guidelines.

8. Limitation of Liability

Moto Mass is a marketplace platform and does not provide tours directly. We are not liable for:

  • The quality, safety, or legality of tours offered by Operators
  • Injuries, accidents, or damages occurring during tours
  • Operator cancellations or failure to perform
  • Disputes between Riders and Operators

To the maximum extent permitted by law, our liability is limited to the fees paid to us for the specific transaction in question.

9. Indemnification

You agree to indemnify and hold harmless Moto Mass, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these terms.

10. Intellectual Property

The Moto Mass name, logo, and all related content, features, and functionality are owned by us and protected by intellectual property laws. You may not use our trademarks without prior written consent.

11. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated through the Platform or via email. Continued use after changes constitutes acceptance.

12. Governing Law

These terms are governed by applicable law. Any disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
